ABSTRACT: This study was conducted in 2008 and early part of 2009 to assess the law enforcement of the Intelligence and Enforcement Group (IEG) of the Bureau of Customs. It focused on the description of the organizational capability of the IEG in five areas. These are the resources, manpower, management competence, linkages and anti-smuggling measures or programs. The study went further to describe the performance of the IEG related to apprehension, confiscation, forfeiture and legal prosecutions. Some factors which influence the capability of the IEG were likewise explored. Testing of hypotheses was done to discover any significant differences in the assessment of two groups of respondents, the BOC personnel (n=346) and the media players, importers and exporters (n=66). These respondents were chosen using the purposing (location) sampling technique for the first group, and the snowball (chain referral) sampling for the second group. Applying the descriptive method of research and utilizing a researcher-made instrument, the findings revealed that: 1. the organizational capability of the IEG is marginally rated in terms of resources, manpower and managerial competence with a tendency to be favorable in the areas of linkages and anti-smuggling measures; 2. the performance record of IEG is assessed to be less extensive in all areas covered, i.e., apprehension, confiscation, forfeiture, and legal prosecutions; 3. the factors which impact on the IEG law enforcement capability (both strongly and marginally) are lack of supplies and equipment, insufficient funds, inadequate facilities, lack of management competence, poor quality of IEG personnel, and internal and external pressures; 4. no significant differences exist in the assessment of the two groups of respondents, regarding the capability of IEG; 5. on the performance of enforcing laws, rules, and regulations related to sanctions for violations of customs policies, significant differences are noted in the responses of the two groups with the outsiders rating the IEG low in its performance. Given the above, findings, the study concludes that there is a strong need to strengthen the capability of the IEG, and proposes an Executive Order for the President of the Republic of the Philippines to consider in order to address the said issue.
