ABSTRACT : According to O'Brien (2011), a lawsuit was filed in 2009 in Superior Court in Vernon, CT alleging that negligence on the part of Victor Hurtuk led to Sara Whittemore's falling on her upper back from a height of approximately four feet during a levitation parachute activity. The school district attorney argued that the Tolland School Board and School Superintendent were legally immune from liability. The Superior Court agreed with the argument brought to the bench. However, the fact that two of four students were injured during a supervised activity on the same day, in the same class within minutes of each other, raised doubts about whether there had been proper supervision. The Superior Court ruled that the negligence lawsuit brought against the Tolland High School physical education teacher by Whittemore could proceed but threw out similar claims brought against the town and the Superintendent of Schools based on the legal doctrine of sovereign immunity. 56
